A 16 July 2008 document outlines the U.S. Customs and Border Protection’s “Policy Regarding Border Search of Information”, applicable to “any individual attempting to enter, reenter, depart, pass through, or reside in the United States”, even “absent individualized suspicion”. Any officer with border search authority can examine hard copy materials, as well as computers, disks, drives and other electronic or digital storage devices, with the ability to retain originals or copies for translation, decryption and/or subject matter assistance.
